開車門害命 泊車賠184萬

〔自由時報記者張筱笛／台北報導〕台北市「上品魚翅餐廳」張姓男員工，去年1月幫餐廳客人開車到酒店續攤，違規停在公車停靠區，下車時未注意後方車輛就貿然打開車門，後方謝姓女機車騎士閃避不及，迎面撞上車門，彈飛路邊，慘遭和欣客運公車輾斃；謝女家屬提告民事求償500萬元，台北地院判張男與上品餐廳應連帶賠償184萬元。可上訴。

刑事方面，張男答應賠償家屬150萬元，並當庭交付50萬元。高等法院今年3月依業務過失致死罪，判張男7月徒刑，緩刑5年，條件是將100萬元分期每月支付2萬元給家屬；至於張男與上品餐廳各自應負擔的賠償比例，將待民事定讞後，由雙方自行協調解決。
