社區停車位問題

我家社區公寓的停車位是機械式兩層的，
我家的停車位是上層，下層為建設公司所有，
建設公司近期將停車位售出，
但因為下層停車位久無人用，所以建設公司完全沒有維修或整理，
然他現在售出後，要求我家要付一半的維修保養費用，
請問這樣的狀況合理嗎？如果不合理我該怎做？
如果合理，相關的法源依據請問在哪裡呢？
