有些觀念就記一下吧~~

1、一事不二罰﹝主不可+主、主可以+副﹞

例如說酒駕同時規定在行政法的規定之中，也犯了刑法的公共安全罪，這時就只能罰一個東西，會以刑法為主~~~這就是一事不二罰，也就是主要懲罰不可加+主要懲罰，但是雖然依照刑法去辦酒駕，行政罰裡的''扣車''''安全講習''''記違規點數''還是可以去罰，這就是主可以+副。

2、刑法比行政先

3、刑法無責、丟回行政

丟去刑法那邊，可能''程度''上沒那麼嚴重時，或證據不足、等等~~就會丟回去給行政去罰，就像老公被抓姦沒被抓成，回家還是要去跪算盤一樣。因為他本來就有罪，只是先去看是否有到刑法那麼嚴重，若無，就丟回去行政，程度上問題，畢竟刑法會有案底，行政比較偏向罰錢了事。
